Service Agreement

These Terms of Service govern your use of GoMaxiTaxi services. By booking or using our services, you agree to be bound by these terms and conditions.

1. Acceptance of Terms

By accessing our website, making a booking, or using GoMaxiTaxi services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

These terms constitute a legally binding agreement between you ("Customer," "you," or "your") and GoMaxiTaxi Sydney ("we," "us," "our," "Company").

2. Service Description

GoMaxiTaxi provides professional 11-seater maxi taxi transportation services in Sydney and surrounding areas. Our services include but are not limited to:

  • Airport transfers to and from Sydney Airport
  • Point-to-point transportation within Sydney metropolitan area
  • Group transportation for events and occasions
  • Corporate transportation services
  • Long-distance travel within NSW
  • Wheelchair accessible transport (where available)
  • Baby capsule accommodation services

Service Availability

Our services operate 24 hours a day, 7 days a week, subject to driver availability and booking confirmation. Service areas may be subject to change based on operational requirements.

3. Booking and Reservations

3.1 Booking Process

  • Bookings can be made via phone (0433 554 676), WhatsApp, or our website
  • All bookings are subject to availability and confirmation
  • We reserve the right to decline any booking at our discretion
  • Booking confirmation will be provided via phone, SMS, or WhatsApp

3.2 Booking Information

When making a booking, you must provide:

  • Accurate pickup and destination addresses
  • Contact phone number
  • Number of passengers (maximum 11)
  • Date and time of service
  • Any special requirements (wheelchair access, baby capsules, etc.)

3.3 Booking Changes and Cancellations

  • Changes: Booking modifications must be made at least 2 hours before scheduled pickup time
  • Cancellations: Free cancellation up to 2 hours before pickup time
  • Late Cancellations: Cancellations within 2 hours may incur a cancellation fee
  • No-Show: Full fare may be charged for no-show passengers

4. Pricing and Payment

4.1 Fare Structure

  • Fares are calculated based on distance, time, and service type
  • Airport surcharges may apply for airport pickups and drop-offs
  • Tolls, parking fees, and waiting charges are additional
  • Public holiday and peak period surcharges may apply

4.2 Payment Methods

  • Cash payment (Australian dollars only)
  • Credit/Debit cards (Visa, MasterCard, American Express)
  • Bank transfer for corporate accounts
  • Payment is due upon completion of service unless otherwise arranged

4.3 Additional Charges

  • Waiting Time: Charged after 10 minutes free waiting
  • Cleaning Fee: $100 fee for vehicle soiling or damage
  • Tolls: Actual toll charges apply
  • Parking Fees: Customer responsibility at destination

Payment Terms

Payment must be made in full at the completion of service. Failure to pay may result in legal action and additional fees. Corporate accounts require approved credit terms.

5. Customer Responsibilities

5.1 Passenger Conduct

  • Passengers must behave respectfully toward drivers and other passengers
  • No smoking, vaping, or illegal substances permitted in vehicles
  • No excessive noise, profanity, or disruptive behavior
  • Food and beverages allowed at driver's discretion
  • Seat belts must be worn by all passengers as required by law

5.2 Luggage and Personal Items

  • Standard luggage allowance included in fare
  • Oversized or excessive luggage may incur additional charges
  • Customers responsible for loading/unloading personal items
  • No liability for lost or forgotten items unless negligence proven
  • Prohibited items: weapons, illegal substances, hazardous materials

5.3 Special Requirements

  • Child restraints must be provided by customer unless arranged in advance
  • Assistance animals welcome with proper documentation
  • Wheelchair accessibility must be requested at time of booking
  • Medical equipment transport subject to safety requirements

6. Driver and Vehicle Standards

6.1 Driver Requirements

  • All drivers hold valid commercial driving licenses
  • Background checks and safety training completed
  • Professional appearance and conduct maintained
  • Local area knowledge and GPS navigation systems

6.2 Vehicle Standards

  • 11-seater vehicles regularly maintained and inspected
  • Clean, comfortable, and air-conditioned vehicles
  • Current registration and comprehensive insurance
  • Safety equipment and first aid kits onboard

7. Liability and Insurance

7.1 Our Liability

  • We maintain comprehensive commercial vehicle insurance
  • Public liability insurance covers passenger injuries during service
  • Liability limited to direct damages actually incurred
  • No liability for indirect, consequential, or special damages

7.2 Customer Liability

  • Customers liable for damage to vehicle caused by passengers
  • Cleaning fees apply for soiling or contamination
  • Customers responsible for ensuring passenger compliance with terms
  • Third-party claims may be passed to responsible parties

Insurance Coverage: Our comprehensive insurance covers passenger safety and vehicle protection. Additional travel insurance is recommended for personal belongings and trip interruption coverage.

8. Force Majeure and Service Disruptions

We are not liable for delays or cancellations due to circumstances beyond our reasonable control, including:

  • Severe weather conditions or natural disasters
  • Road closures, traffic accidents, or construction
  • Vehicle breakdowns or mechanical failures
  • Driver illness or unavailability
  • Government restrictions or public emergencies
  • Airport delays or flight schedule changes

In such cases, we will make reasonable efforts to provide alternative arrangements or reschedule services.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which forms part of these terms.

10. Dispute Resolution

10.1 Complaint Process

  1. Immediate Issues: Contact driver or our phone service during trip
  2. Post-Service: Lodge complaint within 48 hours via phone or email
  3. Investigation: We will investigate and respond within 7 business days
  4. Resolution: Fair resolution offered based on investigation findings

10.2 Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of NSW courts.

10.3 Alternative Dispute Resolution

Before pursuing legal action, parties agree to attempt resolution through:

  • Direct negotiation and discussion
  • Mediation through recognized dispute resolution services
  • Industry ombudsman or regulatory body complaints

11. Termination and Suspension

We reserve the right to terminate or suspend services in the following circumstances:

  • Violation of these terms and conditions
  • Inappropriate, threatening, or abusive behavior
  • Non-payment of fees or charges
  • Providing false or misleading information
  • Safety concerns for drivers, passengers, or public

Termination may be immediate without prior notice in serious cases.

12. Modifications to Terms

We may update these Terms of Service periodically to reflect:

  • Changes in our service offerings
  • Updates to legal or regulatory requirements
  • Improvements to customer protection
  • Operational or business changes

Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of updated terms.

13. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. Invalid provisions will be replaced with valid provisions that most closely achieve the intended purpose.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and GoMaxiTaxi Sydney regarding the use of our services. These terms supersede all prior agreements, understandings, or communications.
